Q: I came across your blog while researching the question of whether or not one can still enter the UK as a visitor if her visa application was refused.

A little background;

We are traveling (My husband, myself, and my five children) to spend a year in the UK on US MILITARY ORDERS so I went through the whole process and just today received notification that our visas are on their way.

We have a close friend who would like to visit us for an extended period of time in order to help with my children. She has been our domestic worker in the past (i.e. nanny, but I did not work outside the home -- she was more like a very helpful roommate while my husband was gone on a 6 month deployment) but we did not document her pay because it was so miniscule as to have been to little to claim on US taxes.

We do not plan on paying her when she stays with us in the UK, but we will be housing her, and generally counting her as a member of the family - taking care of all her needs, including spending money, in exchange for ther help with the family.

She applied for a general visitor visa (I can't remember if she said more or less than six months) and received notice today that it has been refused and that the refusal letter is in the mail. So I am contacting you rather prematurely, not yet knowing the reasons given for the refusal.

I am writing to see if she can just fly in, with a round trip ticket showing she will stay less than six months, and be able to get in just fine without a visa - with only her passport? Also, will her visa refusal keep her out as a general tourist? Does she need to reapply, or appeal? I will know more once she gets her letter, but I just wanted to write you to start the conversation with you, because you may be able to help us (obviously, through your service which costs up to 100 pounds) if we end up needing to reapply. Maybe for now, though, you could please answer the question about being able to just come visit without a visa? Thank you so much --

Ans: Ideally a US citizen if travelling for tourism or business doesn't need a visa (for stay upto 6 months.) A valid US passport is required. A US citizen can apply for visa online through http://www.visa4uk.fco.gov.uk/ApplyNow.aspx.

A US citizen can apply for a visa on arrival. The Immigration officer will interview the applicant and provide a visa for less than 6 months.

A: Hi S,

It is not listed as prohibited reason to enter UK. Shouldn't be a problem.

Q: Hello.

I am a US citizen and am trying to move to live with my boyfriend, a UK citizen, in Scotland. We already have accommodation, our rent starts Sept. 1, 2011. I want to work ideally, but I have not been able to sort out a visa. I feel like I should go over on a visitor visa for 6 months, but wonder if I could volunteer? If I go home and come back then could I go back on another visitor visa? It seems my only other options are to study (too late to get into programs) or become engaged. Do you have any suggestions how I can live in the UK with my boyfriend for the next few years? I thought a tourist visa would be a good place to begin and work from there? Please let me know what you think.

My name is V. I am an external student in University of Birmingham, UK.

I am currently put up in Mumbai. I was suppose to attend my resits in UK for May-June 2011. Therefore i applied for Student visitor visa on 6th April 2011 along with my spouse. I got a refusal stating that funds are not enough. Although the UKBA failed to check only considered my account and ignored my spouse's account. I made an appeal still they stood by their stand.

As i had to go to UK on 14th May 2011 for resits i reapplied again with my Spouse.

I had to pressurise them to consider my application before 13th May 2011 as i had exams on 14th May 2011.

But again i got a refusal stating that my spouse has provided false documents regarding employment.

He has been associated with the same company since 5 yrs. the only problem was he was on leave when the call of UKBA came in to the office and a peon picked it up stating that my spouse is not here.

But the Senior manager got a call as well and he stated the fact he works in this company when he came to know that a peon stated another answer he called back the UKBA office giving them an explanation that my spouse does work here the person picking up the call was infact a peon.

Still the UKBA managed to give us an refusal . I have missed my exams.. I am going to appeal against them..

I have collected all the necessary documents of my Spouse like Appointment letters , verfication letter from Managing director and senior manager ID card etc.. business cards.

The thing is he was on dependent visa with me from oct 2009 - jan 2011. and for his dependent visa he has given the same company documents.

I really dont know what to do .. Even when i provide all the documents can the decision be overturned

I hope you are able to assist me. the paragraph states 320 7(a) which is 10 yrs automatic refusal

A: False documents submission leads to ban of 10 years by UK Home office. You may appeal as long as you have any rights to appeal.

A:  Hi E,

You can apply for the work visa, which I assume is the Tier 2 skilled workers visa. As long as you don't have a clause in the refusal letter which bans you for ten your from entering UK, your next visa application will be dealt with on it's merit.

specially to Sikhs that why

we think to apply under entertainment visitor visa .bcoz we can
fulfill its a requirements.we will show this movie over there freely
and will not get any income .I have got a sponsorship letter from
London .I just want to confirm that the letter contains our full
address not our passport numbers and also the relationship between us
is not written and they are also availing pension but have about 40000
Pounds in there accounts and have 4 room house

we don't need to use there funds, we just need to have accommodation there.

and we also arranged a invitation letter from a society in Birmingham
that invite us to show that movie in uk


what relationship we must write in application a friend or a relative ?

is that sponsor letter eligible although he has not signed it just
given the address and their ni number ?
sponsor also now running a small business now as he written in letter


what the corrections you think we must do and how we can make our case

They have claimed that they have verified your employment details through one Karan Agarwal and found it to be false. I am not sure if it is really false. Did you also submit the payslips along with the letter of employment from the employer and Bank statements to prove that the salary has been credited to your bank a/c each month?

Usually if false documents are submitted, UK Home office Ban the applicant for the next 10 years from entering the country.

Hi Amandeep,

Thanks for writing in. You need to have  a proper sponsorship letter with the passport numbers and your relation with them.

Funds in your a/c should be approx. £700-900 for each month you want to stay there. This is if the accommodation is being provided to you. You will need to mention the exact address of the place you will stay.

Go with the best sponsor. Submitting details of more than 1 will create doubts and confusion.

Hi,

I was wondering if you could help me regarding a visa refusal. My spouse is from pakistan and we applied for a settlement vis to  come to the uk. We submitted documents in december 2011 and two days ago the visa was refused. There was only one reason for the refusal and that was he did not provide evidence of a1 exam. My husband did not submit english exam because he was advised by the chair man of Gerrys that he is exempt from taking the test as he studied medicine and passed in russia for 7years, this course and faculty was all in english. However this is not recognised bu uknaric. He did provide his degree cirtificate. On the day he collected his documents two days ago from the application centre he was given an appeal form.

February 2012 after he submitted documents he took IELTS exam in pakistan, he achieved 5 in speaking, 5.5 in reading, 6 in both writing and listening, is this equivialnt to the a1 exam? or will he still have to take the a1 exam?

Additionaly as he has recieved the certificate to prove he has passed the Ielts exam can he send this with the appeal. Will the appeal still get refused as he didnt submit the paper in the 1st place? or does he have to take the re submitting the whole documents again route? someone advised me he cant appeal but someone advised my husband in pakistan he can get his decision reviewd and doesnt have to re submit everything again? i am so confused as everyone is giving different answers.

Which process is quicker..appeal or resubmission?

The reason why i belive he culd appeal is because he was given wrong advise from Gerrys and this prevented him taking the a1 exam in the 1st place and that is the only reason why he didnt submit it in the 1st place, but now he can show his Iselts certificate. If he was given the right advice he would have taken the exam. But others are telling me different.

Please could you get back to me any info would be much appreciated.

A: I think you can submit an appeal with the IELTS scores which are acceptable.

Dear Sir,

The visa application to UK of one of our participants to the LIYSF has been rejected and we have received the attached communication with as REFUSAL OF ENTRY CLEARANCE  which states that the reason for visa being denied is that “ I am not satisfied that you have a parent or guardian in their home country of habitual residence who is responsible for your care and who confirms that they consent to the arrangements for the travel , reception and care in the United Kingdom “’

As per the attachment they have indicated that we can appeal against this however they have not mentioned to whom, where & how

The travel date is 24th July, will appreciate it if you could guide us in the matter

Needless to say the student & parents are devastated & stand to lose a substantial sum of money if the rejection is upheld

I am Mauritius citizen and I want to go for a short visit to the UK . I can't travel alone, my spouse is Pakistani
citizen and he is banned for 10 years under paragraph (320 A) from Pakistan. Please let me know, if he can apply for a visit visa to the UK. I will be very thank full. Thanks S Khan.
